1. INTRODUCTION

Mamanecó is a brand belonging to the company Fertilea Iberia S.L. with CIF: B02639128 and address at Calle Ramón y Cajal, 5 with Postal Code 28100 Alcobendas (Madrid) Spain.
Mamanecó offers cosmetic products through its e-commerce platform to any user interested in purchasing them at any time and place in Spain and Europe.
By naming Mamanecó we are referring to the company Fertilea Iberia S.L.

2. PRICES

The prices applicable to each product or pack are those indicated on the website. In accordance with the provisions of Law 37/1992, of December 28, 1992, regulating the Value Added Tax (VAT), our products are taxed at 21% VAT rate. The prices indicated on the website are inclusive of VAT.
Mamanecó reserves the right to change prices at any time. In case of specific offers, these will be duly identified.

3. PURCHASE PROCESS AND PAYMENT METHOD

As a customer you can browse our website and our products and enter in the CART all those that are of interest to you. The cart informs you of the products you are including and their total cost. Once you have the product(s) you want to purchase in the cart, the next step is to click on the GO TO CHECKOUT button. After this, a form will be displayed to fill in with the shipping and billing information, necessary to formalize the payment and carry out the shipment.

The payment method is also shown on this page. There are five ways you can pay:

1. By credit or debit card, through the virtual POS on the official and secure Redsys platform.
2. Through BIZUM. In this case you will be asked for the telephone number you wish to use to make the payment and to authorize the bank to execute the payment.
3. Through PAYGOLD, which consists of receiving an SMS with a link to make the payment.
4. Through STRIPE by credit card.
5. Through PAYPAL by credit card.

Payment will be a one-time payment.

Once the payment has been made, you will receive an email with the confirmation of your order.

4. ESTABLISHMENT OF THE CONTRACT

Your order is considered as a binding offer for the establishment of a sales contract for the product.
The contract comes into force at the moment you receive the purchase confirmation email of your order.
During the purchase procedure, you have the possibility to check that the indications you have made are free of errors in the boxes on the top right, before making the payment of the order and, therefore, that the contract comes into force.

By clicking on the FINISH PURCHASE button, you accept the conditions of purchase and, therefore, of contracting.

5. SHIPPING AND DELIVERY TIMES

5.1. Shipping costs.

Shipping costs are free in Spain and Portugal.

For the Balearic Islands, the rates are shown in the appendix.

For the Canary Islands, Ceuta and Melilla you can contact us personally at the following address hola@mamaneco.com.

We ship all over Europe. Rates and delivery times can be found in the appendix.

5.2. Mode of shipment.

Our shipments are made through the transport company Tipsa.

5.3. Delivery terms.

Delivery times will vary between 1 and 3 working days in Spain. Mamanecó works to meet these deadlines, however, is not responsible if the courier company exceeds this period. Saturdays, Sundays and holidays there will be no delivery service and are counted as non-business days.
You will be able to track your package at all times through a link that we will send you by email.

It is the customer's responsibility to check the suitability of the products delivered with respect to the order placed. Any complaint regarding the nature or specifications of the products must be made within 72 hours of delivery at the latest.

In the event of any damage during transport (damage to the packaging), we recommend that you photograph the unopened package and send these photos to hola@mamaneco.com so that we can make the appropriate claims to the courier company Tipsa.

6. ORDER CANCELLATION

Mamanecó reserves the right to refuse any transaction made by credit card, debit card or bizum. In this case we will refund the full amount again as soon as possible and to the same account with which the payment was made.

Mamanecó also reserves the right to request any additional information from the Client to ensure that there is no act of fraudulent or malicious intent.

7. RETURNS

In compliance with Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, information is provided on the right of withdrawal of the user.

Therefore, if you are not satisfied with your purchase you can return it within 72 working hours from the day you receive the products. To do this we only ask you to inform us in writing by e-mail to hola@mamaneco.com indicating the data necessary to locate your order. You can also call us by phone. The costs of collection management will be borne by the customer as long as the reason for the return is not due to Mamanecó. Once we have received the order in our offices you will be refunded by the same means that you made the payment.

8. INTELLECTUAL PROPERTY

Mamanecó reserves all intellectual property rights of its formulas and products, as well as the rights of its brand, its own images and texts of its website.

9. WARRANTY AND LEGAL LIABILITY

For the act of payment of the order, Mamanecó operates with strictly rigorous platforms in data encryption and security during the purchase process. In case of a cyber attack or fraudulent act during the purchase process, Mamanecó is not responsible for what happened.

10. DATA PROTECTION

In compliance with the provisions of Law 15/1999, of December 13, Protection of Personal Data ("LOPD"), we inform you that personal data and information that are incorporated into the purchase form, as well as all the documentation you send us electronically or on paper will be incorporated into a file of personal data owned by Mamanecó. In no way the bank details become visible to Mamanecó.

The questions included in the purchase form are mandatory except for those indicated as "optional". If you do not answer the mandatory questions, you will not be able to complete the purchase process.

Mamanecó explicitly undertakes to keep all data provided by the customer in the utmost confidentiality and not to provide them, under any circumstances, to third parties, unless there is an express authorization or a legal obligation.

The customer may exercise the rights of access, rectification, opposition and cancellation at any time by sending an e-mail to: hola@mamaneco.com.

11. JURISDICTION

For the resolution of all disputes that may arise from this contract, the courts of Madrid, Spain, are competent to exercise commercial law.
